THE DIGITAL SPONSOR APPLICATION IS SOLE PROPERTY OF GLUCOBIT INC AND IT IS PROVIDED TO YOU BY GLUCOBIT INC. 

 

PLEASE READ THESE TERMS OF SERVICE (THE “AGREEMENT”) CAREFULLY BECAUSE THIS AGREEMENT CONSTITUTES A LEGALLY BINDING CONTRACT BETWEEN YOU AND GLUCOBIT INC. IF YOU DO NOT WISH TO ACCEPT THIS AGREEMENT, PLEASE DO NOT ACCESS THIS APPLICATION.  BY INDICATING THAT YOU AGREE BELOW, OR BY ACCESSING, DOWNLOADING, USING TO DIGITAL SPONSOR (interchangeable hereon with “GLUCOBIT APP” or “GLUCOBIT SERVICE”), YOU AGREE (1) TO BE BOUND BY THIS AGREEMENT, AND (2) YOU ARE AT LEAST 18 YEARS OLD, AND (3) YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, AND (4) YOU ACCEPT THIS AGREEMENT. 

 

THIS IS NOT MEANT TO BE A MONITORING APPLICATION AND IS NOT MEANT TO BE USED IN ANY EMERGENCY SITUATION. Any data you enter is voluntarily entered by you. The data being entered is NOT monitored on a regular basis. GLUCOBIT IS NOT ENGAGED IN RENDERING MEDICAL OR SIMILAR PROFESSIONAL SERVICES OR ADVICE.  IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL “911” IMMEDIATELY.

 

 

THE GLUCOBIT SERVICE MAY CONTAIN GENERAL INFORMATION RELATING TO SUBSTANCE ABUSE AND ALCOHOL ADDICTION AS WELL AS VARIOUS OTHER MEDICAL CONDITIONS AND TREATMENTS.  SUCH INFORMATION IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY.  THE CONTENT ON THE DIGITAL SPONSOR APP, WHETHER PROVIDED BY GLUCOBIT OR A USER OF THE GLUCOBIT SERVICE, IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS OR TREATMENT.  ANY CONTENT RELATING TO MEDICAL CONDITIONS AND THEIR TREATMENT IS NOT MEANT TO BE A SUBSTITUTE FOR ADVICE PROVIDED BY A DOCTOR OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL, OR BY A SOCIAL WORKER, PSYCHOLOGIST OR OTHER MENTAL HEALTH PROVIDER. GLUCOBIT IS NOT ENGAGED IN RENDERING MEDICAL OR SIMILAR PROFESSIONAL SERVICES OR ADVICE, AND THE INFORMATION PROVIDED IS NOT INTENDED TO REPLACE MEDICAL ADVICE OFFERED BY A PHYSICIAN OR OTHER MEDICAL OR HEALTH CARE PROFESSIONAL.  YOU SHOULD NOT USE THE INFORMATION CONTAINED HEREIN FOR DIAGNOSING A HEALTH PROBLEM OR DISEASE.  YOU SHOULD NOT CONSTRUE ANY CONTENT AS ANY WARRANTY OR RECOMMENDATION OF TREATMENT.

You are fully aware of the risk inherent in participating in the using the “Digital Sponsor” application (“the activity” from hereon) . You accept and assume full responsibility for all risks of harm and/or loss (foreseeable and unforeseeable) that you may sustain by using the app.

 

Waiver and Release. You agree to release and hold harmless the owners of this application, Glucobit Inc., and all its representatives, affiliates, and staff (“the organizers” from hereon)from any and all liability for any loss and/or harm that you may sustain during the activity. You agree that if you sustain any loss and/or harm during this program, the organizers are not responsible for providing you with any form of financial assistance (e.g., medical benefits, insurance). 

 

Indemnification: You agree to fully indemnify and hold harmless the organizers to the extent your negligent or intentional acts or omissions during participation in the program cause the organizers to incur any loss, liability, damage, or costs (including reasonable attorney’s fees). 

 

 

You are voluntarily participating in the testing of the digital sponsor app (“The activity” or “the application”) and you are participating in the activity at your own risk. You are aware of the risks associated with participating in this activity, which may include, but are not limited to: Physical or Psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and Death. You understand that these injuries or outcomes may arise from your own or other’s negligence, conditions related to travel to and from the activity, physical movement suggestions included in the application, services included in the application or conditions at the activity locations or generally through using the application. Nonetheless, You assume all related risks, both known and unknown to you, of your usage of the app. 

 

You hereby acknowledge that you have carefully read this “WAIVER AND RELEASE” and fully understand that it is a release of liability. You expressly agree to release and discharge the owner of this application, the developers of this application, Glucobit Inc. and all of its representatives, affiliates, members, agents, attorneys, staff, volunteers, heirs, and assigns from any and all claims or causes of action and you agree to voluntarily give up or waive any right that you have to bring a legal action against the owners of this application, the developers of this application, Glucobit Inc. or any of its representatives for personal injury or property damage. 

 

To the extent that statute or case law does not prohibit releases for ordinary negligence, this release is also for such negligence on the part of the representatives and affiliates of Glucobit Inc.
